NY ATTORNEY GENERAL'S OFFICE ACCEPTS UNPRECEDENTED CITIZEN'S COMPLAINT DEMANDING INQUIRY INTO 9/11 CRIMES

NEW YORK -- On behalf of New York State Attorney General Eliot Spitzer, Chief Investigator William Casey today accepted a Complaint and Petition from a group of New York City citizens including 9/11 family members, survivors and a Ground Zero triage physician. The Complaint demands that the AG open a criminal inquiry and/or grand jury investigation into the many still unsolved crimes of September 11, 2001 over which he has jurisdiction.

The complainants first held a press conference to explain the reasoning and desperation behind their unique Citizens' Complaint and Petition, which calls for criminal and civil probes into previously suppressed or ignored areas of inquiry identified by the 9/11 Family Steering Committee, 9/11 CitizensWatch and many independent researchers.

The lead complainants currently include Bob McIlvaine, who lost his son Robert in the World Trade Center collapse; Patricia Perry, who lost her son John, a New York City Police officer; William Rodriguez, a WTC maintenance worker and rescue effort hero; Jenna Orkin, Chairwoman of the World Trade Center Environmental Organization; Dr. Faiz Khan, Ground Zero triage physician; and ambulance first responder, Megan Bartlett, founder of Ground Zero for Peace (who was recently hospitalized with malignant reactions to toxic WTC dust and unable to attend).

In brief statements prior to signing the 20-page Citizens' Complaint, the complainants voiced their hope that the public would strongly support their call to Attorney General Spitzer and also urge him to finally investigate the victim families' questions that the 9/11 Commission would not touch. Explaining the timing of the action, organizers cited the very recent Zogby 9/11 Poll which showed that nearly half of New Yorkers believe officials in this government "consciously" allowed the 9/11 attacks to succeed, and that 66 percent wanted a new and deeper investigation. They further noted steadily accumulating evidence that belies the "official narrative" such as this week's breaking story on the "black box" recorders recovered from the WTC site, the existence of which the FBI and Kean Commission had both insistently denied. Bob McIlvaine reported that during one of the 9/11 Commission hearings, Commissioner Richard Ben-Veniste said, "This is not an investigation. This is an exposition." Justice for 9/11 Steering Committee member, Kyle F. Hence, who opened the event and introduced the Complainants, said that during recent Congressional hearings Commission Vice-Chairman, Lee Hamilton, openly admitted, "We did not answer all of the questions posed by victim family members."

Jenna Orkin stated there was strong evidence suggesting that the Executive Office of the President was responsible for last-minute changes to an EPA press release that confirmed the safety of the air in lower Manhattan, clearing the way for the re-opening of Wall Street. "Here it appears that the government was willing to sacrifice the lives of Americans for purely economics ends." She opened her remarks by predicting that those who will die of exposure to toxic dust from the destroyed twin towers will ultimately far exceed those who died on the day of the attacks. Yet this painful story was relegated to a minor footnote in the 9/11 Commission Report.

After signing the Complaint, members of the Steering Committee and several Complainants walked to 120 Broadway and presented the signed document and several evidentiary books to Chief Investigator William Casey in the office of the New York State Attorney General.

The group cited The Terror Timeline by Paul Thompson, The New Pearl Harbor by David Ray Griffin, The War on Freedom by Nafeez Ahmed, and Crossing the Rubicon by Michael C. Ruppert as key resources that would be useful in any Grand Jury probe convened by the Attorney General.

Attorney Carolyn Betts, legal consultant for the Complaint, noted this was the first Citizens' Complaint filed with a State's Attorney General that would become what she called a "living document" -- in other words, an evolving compilation of argument and evidence posted on the Internet in full public view. Organizers also noted that Americans could view the Complaint at justicefor911.org (see http://www.justicefor911.org) and those who wish to support it can sign a petition on the site.

The group vowed to press their case regardless of upcoming election results, insisting that the search for 9/11 truth, justice and accountability is hardly a partisan concern, as witnessed by the Tuesday release of the 9/11 Truth Statement. The 9/11 Truth Statement also demands deeper new investigations and is signed by 100 prominent Americans spanning every faith and party, including former Republican officials, military officers, and three presidential candidates. The Justice for 9/11 Steering Committee includes representatives from 9/11 CitizensWatch, 911truth.org and the World Trade Center Environmental Organization and was organized this month in New York City.

NEW YORK -- A coalition of 9/11 victim family members, survivors and advocacy groups will deliver a formal complaint requesting a new criminal investigation of 9/11 events to New York Attorney General Eliot Spitzer this Thursday following a 2:00 PM press conference outside the Equitable Building (at corner of Nassau and Cedar Streets). The Complaint petitions the Attorney General to launch an independent in-depth criminal and civil probe of significant 9/11 evidence and lines of inquiry suggesting grave official misconduct including criminal negligence, criminal facilitation, and accessorial abetment of murder, assault, insider trading, obstruction of justice, and other violations of New York law.

The Complaint asks the Attorney General to exercise his powers to establish accountability for crimes under New York State law and recover damages incurred by state and local governments from corporations and individuals whose conduct furthered the criminal conspiracy. The Complainants, including victim family members Bill Dolye and Bob McIlvaine both of whom lost their sons, maintain that few if any of these charges or their bodies of supporting evidence were adequately explored or even addressed by the 2002 Joint Intelligence Inquiry or the 9/11 Commission which released its final report last July.

"For many New Yorkers, AG Spitzer is the last hope for establishing the truth about what happened on 9/11 and enforcing the law," noted spokesperson David Kubiak. "Because administration officials have sought to federalize all 9/11 inquiries and classify evidence under the "state secrets" doctrine to preempt local probes and obstruct the Kean Commission, three years after the tragedy there is still has been no comprehensive, credible independent investigation completed. As the elected official ultimately responsible for public safety and criminal law enforcement in New York, the Attorney General clearly has jurisdiction here if he chooses to assert it. Given the scale of 9/11 carnage and the subsequent illnesses and incalculable damages suffered by New York and evidence of cover-up, his constituents are now telling him that he must. Fifteen New York legislators have even stepped up to endorse this demand so we're at a very remarkable choice point in 9/11 history."

Although the Complaint and its detailed appendices are based upon years of investigative journalism and independent research, their crystallization into legal form was triggered by three recent events: 1) the failure of the Kean Commission Report to provide a credible explanation of the 9/11 tragedies, to hold anyone accountable, or answer most of the questions posed by the 9/11 Family Steering Committee *; 2) the August 31st Zogby 9/11 poll** which showed that nearly half of NYC citizens believe government officials were "consciously" complicit in the attacks, and that two-thirds want a new investigation; and 3) the testimony and evidence put forth at the September 9, 2004 9/11 Citizens' Commission hearings in Manhattan, organized by the watchdog and activist groups 9/11 CitizensWatch and 911truth.org.

The Complaint is also foreshadowed in today's release of the "9/11 Statement," a call for trenchant new investigations signed by over 100 American opinion leaders including presidential candidates Nader, Badnarik and Cobb as well as 50 supportive 9/11 families.

The Statement supports an August 31st Zogby poll that found nearly 50% of New Yorkers believe the government had foreknowledge and "consciously failed to act," with 66% wanting a new 9/11 investigation.

Focusing on twelve questions, the Statement highlights areas of incriminating evidence that were either inadequately explored or ignored by the Kean Commission, ranging from insider trading and hijacker funding to foreign government forewarnings and inactive defenses around the Pentagon. The Statement asks for four actions: an immediate investigation by New York Attorney General Eliot Spitzer, Congressional hearings, media analysis, and the formation of a truly independent citizens-based inquiry.

WE WANT REAL ANSWERS ABOUT 9/11

On August 31, 2004, Zogby International, the official North American political polling agency for Reuters, released a poll that found nearly half (49.3%) of New York City residents and 41% of those in New York state believe US leaders had foreknowledge of impending 9/11 attacks and "consciously failed" to act. Of the New York City residents, 66% called for a new probe of unanswered questions by Congress or the New York Attorney General.

In connection with this news, we have assembled 100 notable Americans and 40 family members of those who died to sign this 9/11 Statement, which calls for immediate public attention to unanswered questions that suggest that people within the current administration may indeed have deliberately allowed 9/11 to happen, perhaps as a pretext for war.

We want truthful answers to questions such as:

1. Why were standard operating procedures for dealing with hijacked airliners not followed that day?

2. Why were the extensive missile batteries and air defenses reportedly deployed around the Pentagon not activated during the attack?

3. Why did the Secret Service allow Bush to complete his elementary school visit, apparently unconcerned about his safety or that of the schoolchildren?

4. Why hasn't a single person been fired, penalized, or reprimanded for the gross incompetence we witnessed that day?

5. Why haven't authorities in the U.S. and abroad published the results of multiple investigations into trading that strongly suggested foreknowledge of specific details of the 9/11 attacks, resulting in tens of millions of dollars of traceable gains?

6. Why has Sibel Edmonds, a former FBI translator who claims to have knowledge of advance warnings, been publicly silenced with a gag order requested by Attorney General Ashcroft and granted by a Bush-appointed judge?

7. How could Flight 77, which reportedly hit the Pentagon, have flown back towards Washington D.C. for 40 minutes without being detected by the FAA's radar or the even superior radar possessed by the US military?

8. How were the FBI and CIA able to release the names and photos of the alleged hijackers within hours, as well as to visit houses, restaurants, and flight schools they were known to frequent?

9. What happened to the over 20 documented warnings given our government by 14 foreign intelligence agencies or heads of state?

10. Why did the Bush administration cover up the fact that the head of the Pakistani intelligence agency was in Washington the week of 9/11 and reportedly had $100,000 wired to Mohamed Atta, considered the ringleader of the hijackers?

11. Why did the 911 Commission fail to address most of the questions posed by the families of the victims, in addition to almost all of the questions posed here?

12. Why was Philip Zelikow chosen to be the Executive Director of the ostensibly independent 911 Commission although he had co-authored a book with Condoleezza Rice?

Those who are demanding deeper inquiry now number in the hundreds of thousands, including a former member of the first Bush administration, a retired Air Force colonel, a European parliamentarian, families of the victims, highly respected authors, investigative journalists, peace and justice leaders, former Pentagon staff, and the National Green Party.

As Americans of conscience, we ask for four things:

1. An immediate investigation by New York Attorney General Eliot Spitzer.

2. Immediate investigation in Congressional Hearings.

3. Media attention to scrutinize and investigate the evidence.

4. The formation of a truly independent citizens-based inquiry.

Given the importance of the coming election, we feel it is imperative that these questions be addressed publicly, honestly, and rigorously so that Americans may exercise their democratic rights with full awareness.
